AusPayNet Summit 2024

Terms and Conditions

The following Terms and Conditions (Terms and Conditions) apply to the Australian Payments Network Summit 2024 (Summit). By registering to participate in the Summit, either in-person or virtually, you acknowledge and accept these Terms and Conditions which form a binding agreement between You and Australian Payments Network Limited (AusPayNet).

1. Registration

  1. You confirm that all information supplied by you to register to participate in the Summit (Personal Information), in your own capacity or on behalf of another person from whom you have express authority, is true and correct.
  2. You must make full payment, in cleared funds and in Australian dollars, of the registration fee, at the time of registration. If you are making payment by EFT, you must make full payment by the earlier of 30 calendar days of the date of registration or 30 calendar days prior to the Summit failing which, AusPayNet reserves the right to not accept your registration. Where payment is made using a credit card, a payment processing fee may be charged if applicable.
  3. Tickets may not be resold or offered for resale. Changes to a registration can only be made in accordance with the Cancellation Policy below.
  4. AusPayNet reserves the right to not accept your registration and/or close registration for the Summit at any time for any reason without prior notice.

2. Conditions of In-person Participation

  1. You must adhere to the conditions of entry of the event venue and obey any lawful directions and instructions given by AusPayNet staff, the venue and/or other event authorised personnel.
  2. You must comply with any COVID-19 requirements or measures taken by AusPayNet and/or the Summit venue which may include but are not limited to social distancing and QR Code check-in, and any other COVID-19 or other health and hygiene requirements or recommendations from Australian state or federal governments.
  3. If you are displaying any symptoms of COVID-19 you must not attend the Summit in-person. Any changes to the Summit delegate or exchanges of an in-person participation registration are to be made in accordance with the Cancellation Policy.
  4. You may be required to present photo ID as proof of identity and if a ticket name does not match your photo ID, AusPayNet reserves the right to refuse your entry to the Summit.

3. Conditions of Virtual Participation (where available)

  1. You acknowledge and agree that registration for virtual participation in the Summit is for your personal use; any changes to a virtual participation registration can only be made in accordance with the Cancellation Policy.
  2. You must ensure that you have appropriate technology, equipment, internet connectivity and speed to participate in the Summit. AusPayNet will not be liable for any interruption, sound or picture quality problems experienced by you.
  3. You will not be entitled to a refund if you are unable to participate in the Summit due to any technological, equipment, internet connectivity or speed issues.

4. Privacy

  1. AusPayNet collects your Personal Information for the administration of the Summit and for future marketing and promotional purposes relating to AusPayNet and/or the sponsors of the Summit.
  2. You agree to receive email correspondence from AusPayNet and the Secretariat (Concept Event Management - paymentsummit@conceptevents.com.au) in relation to the Summit by providing your email address during registration. You acknowledge and agree that AusPayNet may disclose and use your Personal Information for the purpose of administration of the Summit in accordance with these Terms and Conditions.
  3. You acknowledge and consent to your name, organisation, contact details and job title being published in delegate lists and shared with other delegates, sponsors and commercial partners in advance of, during and/or after the Summit for the purpose of networking and marketing. You may request these details be withheld at any time by contacting the Secretariat or opting out during registration.
  4. The sessions at the Summit may be photographed, recorded or streamed live via audio and visual. You acknowledge and consent to photographs being taken and being used in publication and promotion materials for the Summit including on our website and to the recording of and/or the publication and/or use of your image, voice, statement or otherwise, in the session records at the Summit. Please contact the Secretariat if you do not want to be photographed or recorded during the Summit.
  5. These Terms and Conditions should be read in conjunction with AusPayNet’s Privacy Policy which describes how AusPayNet manages the personal information that it may collect, hold, use or disclose for the purposes of its functions and activities. AusPayNet’s Privacy Policy is available at www.auspaynet.com.au/terms. AusPayNet’s Privacy Policy does not apply to any third-party products, services or businesses who will provide their services under their own terms of service and privacy policy.

5. Cancellation Policy

  1. AusPayNet reserves the right to change, modify, reschedule or cancel the Summit at its discretion due to any circumstances, including, without limitation, unavailability of venue, government restrictions (including any restrictions related to COVID-19), or any other cause. Details of any such changes will be published on the AusPayNet website.
  2. If the Summit is changed, modified, rescheduled or cancelled due to any circumstances, AusPayNet will in its sole discretion determine whether to:
    1. hold a virtual Summit only and exchange in-person tickets with virtual tickets; the difference in registration fee between in-person and virtual participation will be refunded and instructions how to login and access the virtual event will be sent to registered delegates;
    2. reschedule the Summit to a date when the Summit can be held; and/or
    3. refund the ticket price in part or in full.
  3. You will be advised via email of any variation to the Summit and provided with relevant details of substitution to virtual, rescheduling or cancellation and where relevant an estimated date for a full or partial ticket refund.
  4. Where you have purchased a Table which includes tickets for 8 registered delegates to attend in person, no refunds, including partial refunds, will be provided where you have less than 8 registered delegates attend the Summit.
  5. AusPayNet will not be liable for any claims for compensation (including any claims for travel, accommodation or other expenses or inconvenience) incurred by you in connection with any change to the Summit, whether it be changed, modified, rescheduled or cancelled for any reason.
  6. Individual changes or cancellations to registrations must be notified in writing to the Secretariat. (paymentsummit@conceptevents.com.au). Verbal changes or cancellations cannot be accepted.
    1. Cancellations received before COB Friday 1 November 2024, will be refunded (less a $100 administration fee).
    2. Cancellations received after COB Friday 1 November 2024, will NOT be refunded.
      • A replacement delegate may attend the Summit provided the change in delegate’s details are notified in writing to the Secretariat by COB Monday 2 December 2024;;
      • Where the Summit is also offered virtually, in -person Summit registrations may be exchanged for virtual Summit registrations and any difference in value refunded to you provided the request is notified in writing to the Secretariat by COB Monday 2 December 2024; no refund will be provided where the request to exchange an in-person registration for a virtual registration is received after COB Monday 2 December; no exchange will be permitted where the request is notified in writing to the Secretariat after COB Monday 2 December 2024.

6. Release of Liability

  1. You release AusPayNet and the Secretariat from liability for any losses, costs (including legal costs and disbursements) damage or claims, including but not limited to:

    1. personal injury of any kind; and
    2. damage to, loss of or destruction of property of any kind;

    except to the extent that such loss, cost, damage or claim is directly caused by AusPayNet’s or the Secretariat’s negligence.

  2. To the maximum extent permitted by law, AusPayNet does not accept any responsibility for and will not be liable for loss, injury or damages (whether direct, indirect, special or consequential) arising out of or in any way connected to the Summit, except for any liability which cannot by law be excluded.
  3. You accept that any information (including any opinions) included in the Summit is general in nature, is for educational and/or discussion purposes only. You acknowledge that you must seek independent advice before acting upon any opinion, suggestion or recommendation made during the Summit. AusPayNet’s liability for any cause of action, including but not limited to breach of contract, negligence or other breach of duty, is limited to the sum of monies paid by you in connection with your registration for the Summit.
  4. You must indemnify and keep AusPayNet indemnified against all losses, costs, and expenses (including actual legal costs and disbursements on a full indemnity basis) incurred in connection with any claim, demand, action or proceedings arising wholly or partly from your negligent or reckless act(s) or omission(s) or breach of these Terms and Conditions.

General Terms

These terms and conditions are made under and governed by the laws applicable in New South Wales, Australia. You and AusPayNet irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
